Weblytics Digital / terms
Terms of Service
Effective: 16 October 2026
These terms govern use of the Weblytics Digital website and the process for requesting an introductory consultation. A consultation request is not acceptance of a project.
Who provides this website?
Weblytics Digital is a business name registered in Kenya and owned and operated by Warren Makhotsa. References to “Weblytics Digital”, “we”, or “us” mean the proprietor operating under that business name. Contact weblyticsdigitalkenya@gmail.com with questions about these terms.
Using this website
You may use this website for lawful purposes and must not interfere with its operation, security, or availability, attempt unauthorized access, or use it to infringe another person’s rights. Website content is provided for general information about the studio and its services. Service descriptions do not guarantee that a particular service is available or suitable for a particular project.
Consultation requests
You may use the booking form to request an introductory consultation. You are responsible for providing accurate information and for not including sensitive information that is not needed to arrange the meeting. A request is subject to availability and system confirmation. It does not itself create a client relationship, accept a project, or commit either party to a project.
Projects and separate agreements
A client engagement proceeds only after Weblytics Digital and the client agree to it in writing. The project proposal or contract will establish the relevant deliverables, fees, payment schedule, timelines, revisions, client responsibilities, intellectual-property ownership and licences, support or maintenance, and termination provisions. The signed project-specific agreement governs that engagement if it conflicts with general website information. No fixed price, payment schedule, refund rule, revision count, delivery date, or transfer of intellectual-property ownership is created by these website terms.
Client materials and approvals
You are responsible for having the rights needed to provide materials, content, data, and brand assets for a project. The applicable written agreement will identify the materials, approvals, access, and cooperation needed for the agreed work. Portfolio use of a client name, work, or results requires the client’s permission or another lawful basis.
Third-party services
A website or project may rely on third-party hosting, software, platforms, or services that have their own terms and availability. Responsibilities for accounts, subscriptions, integrations, and access will be set out in the relevant project agreement. Weblytics Digital cannot control changes or interruptions caused by third-party providers.
Website availability and information
We make reasonable efforts to keep the website available and its information useful, but access may be interrupted by maintenance, networks, hosting, or other technical issues. Website information is general and is not a promise of a particular search ranking, revenue, business outcome, or uninterrupted service. Project-specific warranties or service levels must be agreed in writing.
Intellectual property
Unless a project-specific agreement says otherwise, website text, design, branding, and other materials presented on this website remain with their respective rights holders. These terms do not transfer ownership of website content, client work, source files, pre-existing materials, or third-party components. Any licence or ownership of project deliverables will be established in the written project agreement.
Privacy
Personal information submitted through this website or booking form is handled under the Privacy Policy. Third-party platforms used in a project may process information under their own terms and privacy notices.
Governing law and disputes
These website terms and their interpretation are governed by the laws of Kenya. If a concern arises, contact weblyticsdigitalkenya@gmail.com so the parties can try to resolve it through discussion. If it is not resolved, either party may pursue remedies available under Kenyan law before a court or other body that has jurisdiction. These terms do not create an arbitration agreement or an exclusive dispute venue. Any project-specific dispute process must be set out in the relevant written agreement.
Liability
Nothing in these terms excludes or restricts a responsibility or liability where doing so would be unlawful. These website terms do not create a project-specific warranty, remedy, indemnity, or liability cap. Any project-specific allocation of risk must be agreed in the written contract and remain subject to applicable law.
Changes and contact
We may update these website terms by publishing a revised version with a new effective date. Questions about the website or these terms can be sent to weblyticsdigitalkenya@gmail.com.
